Terms of Service

Introduction

These Terms of Service (“Terms”) govern your institution’s use of the You-Attend application (“the Service”). By enabling and using You-Attend through your Learning Management System (LMS), your institution agrees to these Terms.

You-Attend is licensed only to institutions, not individual users. Access is granted exclusively through the LMS using LTI 1.3 authentication.

Use of the Service

Institutions may use You-Attend solely for legitimate educational and administrative purposes, including:

Recording and managing attendance
Viewing course rosters
Generating attendance reports
Integrating attendance data with the LMS

Users may not:

Attempt to bypass LTI authentication
Reverse engineer or modify the Service
Use the Service for unauthorized or unlawful purposes

User Accounts and Authentication

You-Attend does not create or manage standalone user accounts. All authentication is performed through the LMS using LTI 1.3 and OpenID Connect.

Institutions are responsible for:

Managing user access in the LMS
Ensuring only authorized individuals launch the tool
Role assignments (Instructor, Learner, etc.)

When a user is removed from a course or LMS, they automatically lose access to You-Attend.

Data Privacy and Protection

You-Attend collects only the minimum information required to identify users and record attendance.

The Service does not collect:

Social Security Numbers
Dates of Birth
Addresses
Grades or academic content

Institutions may configure which fields (e.g., email) are shared. Data is never used for marketing or sold to third parties. All data transmitted to and from the Service is encrypted using HTTPS/TLS.

Institution Responsibilities

The institution agrees to:

Maintain accurate LMS enrollment and role information
Comply with applicable laws (e.g., FERPA)
Ensure appropriate technical configuration of the LTI integration

Institutions are responsible for user training and communication regarding the use of You-Attend.

Service Availability

You-Attend strives to maintain reliable service availability. Scheduled maintenance windows are communicated whenever possible.

The Service is provided “as is” without warranty of uninterrupted uptime, though historically downtime has been minimal.

Data Retention and Deletion

Attendance data is retained for the duration of the institution’s contract. Upon termination:

All institutional data is removed from production
Backups are overwritten on their natural schedule

Institutions may request earlier deletion at any time.

Limitation of Liability

You-Attend is not liable for:

LMS outages or misconfigurations
Incorrect attendance entries made by instructors
Institution-managed user access issues

The total liability for any claim is limited to the amount paid by the institution for the Service during the current contract year.

Modifications to the Terms

These Terms may be updated periodically. The “Last Updated” date will reflect any changes.
